For one thing, trying to sue Microsoft is a joke. They'd never win. Two, this "lawsuit" is just a fricken joke. Oh, boohoo, they couldn't play their Halo 3 online for a day. Cry me a fricken river. I couldn't play one of my two DS games because the battery needed to recharge, but do you see me suing Nintendo? >_>

This case doesn't have any ground to stand on. It'd be laughed out of the courtroom the moment it would get in.

Well, I'm pretty they are legally entitled to a partial or full refund of their subscription. If Xbox Live was free, then they'd have no ground to stand on.


But I'm pretty sure the monthly fee is less than 5 million dollars, so...

You've obviously never played trials and tribulations.

The second case you do is trying to prove some guy innocent of theft. No murder is involved in that case.

Also, I appreciate some of those "ads". They are called feature slots, sometimes they contain advertisement, but more often they contain publicity for new downloads, more often than not free, or just really good. I can't count the number of times I've gotten something good from those.

Also, this case will establish a precedent, we cannot afford it to succeed.

Also, it couldn't have been shut down for a week straight, cause I was able to access live whenever I got on for the last month, and I get on every day or so for FFXI.

True, he took on the case under the label of larceny, but what did it ultimately become? Murder! *dramatic flare*

Ads, "Feature Slots"; tomato toe-mah-toe. The point is, Microsoft collects money for the 'Features'...featured on there that they themselves aren't advertising for. That "One Missed Call" 'feature' is getting on my nerves, honestly.

And as far as establishing a precedent...can you really not think of another case where the plaintiff was suing on the grounds that they had not received goods/services in exchange for money? Sounds like that tired old scenario to me, even in the land of digital distribution and electronic bank accounts.

True, the value being fought over is nothing short of insane and will probably cause the case to either be thrown out, or ruled for a lesser amount, but the idea behind the case itself is solid.
