Preamble We, the members of the Independent Colonial Era sign this document to preserve our existence, democratic government and our member’s rights.The government branches of the Independent Colonial Era will be interlinked with each other, although each one has it’s own separate identity and jurisdiction and every legislative body is entitled to having their own Charter to establish basic procedures and protocols. Article I: Membership Section A: Requirements for Membership I. In order for a Cyber Citizen to be accepted into the Independent Colonial Era, they must reside in one of the following cities: London, Paris, Rome, Mexico City, New York, Los Angeles or Dallas. II. In order for a Cyber Citizen to be accepted into the Independent Colonial Era, they must remain be active, check the CyberCitizens forums on a daily basis, work on a daily basis and keep their Nourishment rating at 100% as well as other Ratings to a reasonable level when possible. III. In order for a Cyber Citizen to be accepted into the Independent Colonial Era, they must complete the registration form on the Independent Colonial Era forums, pledge an oath of loyalty to the Independent Colonial Era and not have been involved in any criminal activity (fights, robberies, vandalisms, poaching, etc) or have an active arrest warrant against them. They also may not have had any arrest warrant on them in the past month. IV. In order for a Cyber Citizen to be accepted into the Independent Colonial Era, they must agree to make at least one (1) account at least one (1) of the other Northern Branches. V. In order for a Cyber Citizen to be accepted into the Independent Colonial Era, they must work for the Independence Cooperation in Paris or another recommended company in another city. Section B: Requirements for Acceptance into the Independence Assembly I. In order for a member of the Independent Colonial Era to be accepted into the Independence Assembly, they must have completed any and all requirements set forth by Article One, Section I of the New Northern Era’s Charter. II. In order for a member of the Independent Colonial Era to be accepted into the Independence Assembly, they must have completed all of the tasks provided to them by the Education Officer and the Junior Officers of Education. III. In order for a member of the Independent Colonial Era to be accepted into the Independence Assembly, they must have been members for at least one (1) month. They also must have active in the previous month and voted for the appropriate candidate for Mayor. Section C: Termination of Membership I. Any Assembly member may make a motion to expel a member of the Independent Colonial Era or any Assembly member. The motion has to have at least two (2) supports in addition to the original Assembly member. Reasonable evidence has to be provided and deemed just by the Supreme Justice. II. In order for any one member to be expelled, the Independence Assembly must vote on it and pass the motion through a simple majority (50%+1) within 48 hours of the start of the voting process. III. The Supreme Court shall vote for 24 hours in favor or against the motion to expel a member. Their decision is final and the expelled member may not rejoin for another 30 days, unless otherwise stated by the Supreme Court. Article II: Government The Government of the Independent Colonial Era consists of numerous positions headed by the Chairperson and the Vice-Chairperson who jointly appoint Officer positions but is ruled by the Independence Assembly, which in essence is the legislative body of the Independent Colonial Era. Section A: The Chairperson I. The Chairperson of the Independent Colonial Era is the official leader of the alliance in both internal and foreign affairs. S/he is elected once every six (6) months and appoints his/her Council before the election. II. The Chairperson is responsible for passing Chair Orders, making Speeches from the Chair, supervising his/her cabinet and representing the Independent Colonial Era to the rest of CyberCitizens. III. The Chairperson also may pass very limited Party By-Laws which cannot be repealed by the Independence Assembly. IV. The Chairperson may be impeached by a 2/3 majority from the Independence Assembly. Section B: The Vice-Chairperson I. The Vice-Chairperson is appointed by the Chairperson while running for office or just before the campaigning process. II. The Vice-Chairperson is to be a substitute for the Chairperson when s/he is unavailable for two two (2) days or more. The Vice-Chairperson will also be the Acting Chairperson in the case the Chairperson is impeached or resigns. The Chairperson may also delegate some of his duties to the Vice-Chairperson. III. The Vice-Chairperson may not be impeached by the Independence Assembly. Section C: The Council I. The Council shall be made up of eight (8) members appointed by the Chairperson approved by the Independence Assembly. There shall be a Vice-Chairperson, a Recruitment Chief, a Media Chief, an Education Chief, Defense Chief, Development Chief, Foreign Chief, Finance Chief and a Culture Chief. II. The Officers may pass Ordinances regarding their own Committees, which may be repealed only by the Chairperson or Vice-Chairperson. III. The head of the Council is the Vice-Chairperson. S/he may not dismiss the Officer , unlike the Chairperson. However, the Council may elect a presiding head in times of crisis and meetings. Section D: The Independence Assembly I. The Independence Assembly is a legislative body made up of the Citizens of the Independent Colonial Era. It is also meritocratic. II. The Independence Assembly can repeal any action made by the Chairperson or the Vice-Chairperson through a simple majority vote. They may also impeach the Chairperson through a 2/3 majority vote. III. The members of the Independence Assembly may expel a member from the Independence Assembly through a super-majority of 3/4 and in turn from the political party. However, this action must get approval from the Supreme Court. IV. Members of the Supreme Court may not vote on termination of membership votes to prevent biased rulings. V. The members of the Independent Colonial Era are eligible to petition the Independence Assembly for membership once they have been a member for at least one (1) month, graduated the Academy and have completed all the standards set in Article I, Section B. Independent Colonial Era members may not petition for acceptance more than once a month. All petitions will be made at the end of the month to be voted upon on the next month. VI. The People’s Assembly shall elect an Assembly Speaker for six (6) month terms to be the official Administrator. The Assembly Speaker shall appoint a Deputy Assembly Speaker who has to be approved by the People’s Assembly. Section E: Supreme Court I. The Supreme Court is shall be responsible for handling any and all cases, appeals and terminations of membership cases. It shall be made up of four Justices: one (1) Supreme Justice and three (3) Associate Justices. II. The decision of the Supreme Court is final in appeals and membership rulings. All rulings of regular cases may be appealed one week after the ruling has been given. III. The Supreme Court shall be headed by an elected Supreme Justice. Elections shall be a total of two (2) weeks - a single week for campaigning and a single week for voting. Terms are six (6) months long. IV. A single Justice, appointed by the Chairperson presides over regular cases but all the Justices have to be involved in appeals although the Supreme Justice shall be the primary Administrator. V. The Associate Justices are responsible for keeping detailed protocols, case studies and records of all cases. VI. The Supreme Court may employ Assembly members as Clerks but they may not preside over cases, Article III: Election Procedures Elections are a major part of any democracy. This is no exception in the Independent Colonial Era as there are elections for three (3) seats every six (6) months - the Chairperson position, Assembly Speaker position and the Superior Justice position. There is also a special type of election for the Mayor nominee from the Independent Colonial Era. Section A: Regular Procedure I. In order for any single candidate to successfully win an election, they must surpass the 50% mark. II. Voting period is a single week and the campaigning period is a single week. Additional voting periods are two (2) days apiece. III. No vote may be ended earlier. IV. There may not be more than five (5) candidates for any single position. In case there are, there will be runoff elections and the people which the lowest amount of votes will be dropped until there are only five (5) candidates. V. In order for members to be eligible, they have to be members of the Independence Assembly for at least one (1) month, has to be nominated and seconded by Assembly members and accept the nomination. VI. In order for any one candidate to reign victorious, they must have achieved a simple majority (50%+1) from all the members. VII. Every member that has successfully completed the Academy is eligible to vote. Section B: Runoff Elections I. Runoff Elections are elections held when none of the candidates have achieved a simple majority or when there are more than five (5) candidates for a single position. II. Runoff Elections shall last two (2) days in addition to the week of regular voting. III. Runoff Elections shall be administered by the incumbent Chairperson of the Independent Colonial Era. IV. Results of the Runoff Elections shall be based off the total amount of members that voted. Section C: Mayoral Elections I. The members of the Independence Assembly of the Independent Colonial Era shall vote for the member of the Independent Colonial Era to solicit all of the votes of the Independent Colonial Era’s members. The elections shall be held once every four (4) months and all members are required to vote for their candidate in their city. II. Elections shall be a month long - three (3) weeks for campaigning and one (1) for voting. III. In order for the Independent Colonial Era to have elections for a city, that city has to have at least five (5) Assembly members residing there and be eligible to vote or have 50% or more of the Independent Colonial Era members residing there, whichever is less. IV. The member that is elected shall write campaign speeches, create graphics and advertise his/her campaign to the residents of that city with the assistance of the Media Committee. V. Once elected, every resident of the Mayor nominee’s city must vote for him or face trial. VI. In case of a tie, the incumbent Supreme Justice shall break it. Article IV: Amendments and Disbandment/Mergers Section A: Amendments I. This Constitution may be amended by a simple majority (50%+1) from the Independence Assembly with the consent of the Chairperson or the Assembly Speaker. II. The Assembly Speaker or the Chairperson may not vote on amendments as they must approve or reject it. III. The Chairperson may overturn the Assembly Speaker’s decision and the Assembly Speaker may overturn the Chairperson’s decision. IV. The Independence Assembly may overturn the Assembly’s and Chairperson’s decision with a 2/3 majority vote. Section B: Disbandment]/b] I. The Independent Colonial Era may disband through a unanimous vote from the Council and a super-majority (75%) from the Independence Assembly. II. The Chairperson also must vote in favor of the disbandment. III. The Council shall remain in power until all other members have changed their party affiliation in-game. Only then can they change their party affiliation and start seeking other parties. Section C: Mergers I. The Independent Colonial Era may merge through a simple majority (50%+1) from the Independence Assembly. II. The Independent Colonial Era may not merge into another political party; other political parties may merge into the Independent Colonial Era and the Independent Colonial Era may merge with other parties to form other parties. III. The Council shall remain in power until all other members have change their party affiliation in-game. Only then can they change their party affiliation. |
