Constitution of the Mexican Empire

Article 1 The Executive Power Section 1. The Emperor. The Emperor shall be the head of the State of the Mexican Empire. Only those of Luis Diego Sanchez’s blood line may ever become emperor. Upon the death of the emperor his closest living heir shall take the throne. No person may become high Chancellor unless they profess the catholic religion and remain in good standing with the church. Section 2. The Powers of His Highness the Honorable. 1. The Emperor shall be allowed to declare war on any nation for 365 days without the approval of the legislative body. 2. The Emperor shall be in charge of all diplomacy with other nations, such as sending and receiving ambassadors and meeting with foreign officials and handling the overall foreign policy. 3. The Emperor shall be allowed to appoint a group of advisors to help him with his duties. These advisors shall be known as Imperial Ministers. 4. No treaty with another nation shall come into effect that the Emperor hasn’t agreed upon and has been approved by a majority vote of the senate. However in times of urgency the Emperor may superseded the senate in matters of treaty making if he believes it to be in the best interest of the country. 5. The Emperor shall the final judiciary authority with the power to pardon or reduce the sentence of those convicted as well as increase sentences when he sees fit to do so. 6. If the Emperor looses faith in the Legislature as a whole, he may dismiss them and call an emergency election. He can only dismiss the whole body and not a few individuals. He may however dismiss the Chancellor if he believes it to be in the best interest of the Nation. 7. The Emperor can veto, any legislation signed by the Chancellor if he believes that doing so is in the best interest of the nation. 8. All powers not mentioned herein and not given to the legislature or the Chancellor shall also rest upon the Emperor
Section 1. Chancellor 1.The executive Power shall be vested in a Chancellor of the Mexican Empire. The Chancellor shall serve as the head of the government. The Chancellor election process begins with the senate nominating as many as 5 persons per party with a minimum of three persons per party to run. The emperor then nominates one person per party to run for the position of Chancellor. The Chancellor is then chosen by popular vote with a minimum of 50% required to win the election. If no candidate gets 50% the two candidates with the highest majority participate in a runoff election. Elections occur on a 6 year basis No chancellor may serve more than four terms in a lifetime and never a consecutive term. However if the Emperor so chooses he may issue a decree granting an exception allowing a chancellor to run for a consecutive term as well as allow them to serve more than four terms. The Emperor can never appoint a Chancellor they must always be elected. No person can be a Chancellor if they have not reached 35 years of age, been a natural born citizen of Mexico and have resided in Mexico for a minimum of 20 years. Exceptions for all citizens of the newly acquired states shall be made so long as they profess their allegiance to the Emperor. No person may run for Chancellor unless they profess the Catholic religion.
Section 2. Powers of the Chancellor 1.No law, bill, or resolution shall become law unless the Chancellor approves it. 2.The Chancellor may veto any law passed by the legislature, though the veto can be overridden with a 2/3 majority vote in both houses of the legislature. 3.If any legislations sits on the Chancellor’s desk for ten days without being approved or vetoed it will automatically become law. 4. The Chancellor must submit a budget to the Imperial Assembly every year. 5. The Chancellor must make a formal address to the people at least once a year, usually in the First quarter. 6. Has the power of to create executive orders. These orders must strictly cite the law or act that they want to clarify or further a law that was put forth by the legislature, or the constitution. This shall not be used as a way to make laws without the consent of the legislature, merely to act on the laws already created by the legislature or in the Constitution. 7. The Chancellor shall have the power to run government programs and departments as he sees fit. At any time the emperor may reverse any order or directive given to a department or program if he believes it is in the best interests of the country.
8. The Chancellor shall be allowed to appoint a group of advisors to help him with his duties. These advisors shall be known as Secretaries and must be approved by the senate. 9. The chancellor shall appoint a deputy, (that must be approved by a majority of the senate) to fulfill his duties if he is unable to do so, as a result of death, illness, urgent matter, or removal from office by the emperor. The deputy shall only handle the duties of the Chancellor until the time that a new Chancellor is elected. 10. The power to appoint 11 judges to the Supreme Court of Justice of the Nation these appointments must be confirmed by the senate. At any time the emperor may deny any appointment if he believes it in the best interest of the nation. 11. All powers not mentioned herein and not given to the legislature shall also rest upon the Chancellor
Article 2. The Legislature
Section 1. Senate 1.The Senate shall be the upper house, shall consist of 163 members. The Senate consists of Two senators for each of the 38 states and two for the Federal District elected by popular vote within their state of federal District. Thirty-Nine national senators-at-large, divided among the parties in proportion to their share of the national vote. Forty Six Senators are chosen by the emperor 2. All Senators serve a term of six years with the entire body coming up for election and no member except for the 46 chosen by the emperor to serve a consecutive term 3.No Senator shall serve more than four terms in his lifetime and never a consecutive term. However the 46 senators appointed by the emperor are exempt from this rule. 4.No person can be a Senator if they have not reached 25 years of age, been a citizen of Mexico for 12 years and resided in Mexico for 10 years. Exceptions for all citizens of the newly acquired states shall be made so long as they profess their allegiance to the Emperor. No person may run for the senate unless they profess the Catholic religion.
5.The Senate shall choose a presiding officer known as the President of the Senate
Section 2. Chamber of Deputies 1. The Chamber of deputies consists of 646 members (1 for every 300,000) 300 deputies are chosen by direct election. 200 deputies (known as party deputies) are chosen by proportional voting. The remaining 146 deputies are chosen at the discretion of the emperor. Election for deputies occurs every three years with the entire body coming up for election and no member except for the 146 chosen by the emperor to serve a consecutive term 3.No Deputy shall serve more than 8 terms in his lifetime. However the 146 deputies appointed by the emperor are exempt from this rule 4.No Person can be a deputy if they have not reached the age of 18, been a citizen of the Mexico for 6 years and lived in the Mexico for five years. Exceptions for all citizens of the newly acquired states shall be made so long as they profess their allegiance to the Emperor. No person may run for the chamber unless they profess the Catholic religion.
6.The Imperial Assemblyman’s shall choose a presiding officer known as the President of the Chamber
Section 3. Powers of the Legislature. The Senate shall be the only house that needs to approve a declaration of war or peace, approve a treaty, and confirm appointed government officials. They shall also proceed over any impeachment of any government appointed official, deputy, senator, or Chancellor. The Chamber shall be the only house that can have bills relating to the gathering of revenue originate with in itself. It shall also be the house where warrants to impeach a government official shall occur in. To create bills relating to punishments, and fines and such. To create and raise an army To coin and regulate money To create a police force and maintain prisons to protect the nation. To create programs to set health standards To create programs to set banking and business regulation To create and maintain roads To create programs, laws, and regulations for the benefit of the nation. All powers not mentioned herein and not given to the Emperor or Chancellor shall also be given to the legislature.
Article 3. State Governments 1.All states within the Mexico shall have a local governor/legislative/Judicial and to run the day to day affairs of the state with similar powers as they have always had. Though each state understands that federal law shall always trump state law no matter the situation and that Federal government has the right to intercede in state affairs whenever it is deemed necessary by Imperial Senate of the Federal Legislature.
Article 4. Compensation for the Senate, Chamber of Deputies, Chancellor, and the Emperor. 1.Compensation for all services rendered by the Senate, Chamber of Deputies, Chancellor, and the Emperor shall be ascertained by law and paid out by the Treasury.
Article 5. Judicial Branch. Section 1 Supreme Court of Justice of the Nation The judicial branch will consist of the Supreme Court of Justice of the Nation which will be the absolute law of the land only be to be override by an amendment made to the Constitution. The Supreme Court of Justice of the Nation shall consist of 11 judges appointed by the Chancellor and approved by the Senate. Each Judge shall serve a term of 16 years and may serve no more than three terms in their life time. Unless granted a decree from the emperor to do so. The judicial branch has the right to determine if any law passed by the legislative and executive branch is allowed in the constitution. If they deem a law unlawful according to the constitution they have the right to void the law. They shall also hear all law cases that have passed through a lesser and lower court and have yet to be resolved.
Section 2 Lower Court The Lower court shall consist of 1 judge in each district in the state. Each judge shall be elected by the people of that district and server a term of eight years. A judge of the lower court may serve as many terms as he and the people of his district wish. The Lower court shall hear and rule on all cases that have passed through the lesser court and yet to be resolved.
Section3. Lesser Court The Lesser courts shall consist of as many judges that are needed in a particular district. The lesser court judges shall be chosen by popular vote and shall serve a term of four years. All judges of the lesser court may serve as many terms as they and the people wish.
Article 6. Rights of the people.
Section1. Right Pertaining to Judiciary
1.People have the right of privacy. People shall be protected from unlawful search and seizure. A warrant from a judge must be acquired to search any individual or anyone’s home or private space where privacy in expected. 2.Anyone accused of a crime has the right to not incriminate himself, to be presented before a judge within 72 hours of his arrest, to have a public trial judged by a jury of 12 of his peers, the right to be confronted with the witnesses against him, and the right to a proper defense which the nation will provide if the accused is unable to afford one. 3.Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Section 2. Political Rights 1.Anyone over the age of 18 shall be able vote in any election whether it be a federal or state election 2.The people have the right to assembly in protest in front of all government buildings as long as entrances and fire exits aren’t blocked and civilians are not being harassed whether physically or verbally. 3.Anyone may make a bid for political office or hold political office as long as they meet the requirements 4.Age, citizen, resident requirements and not have a felony record.
4. Any political party shall not be barred from having their name on the ballot. 5.Any citizen of the Mexico shall be able to request a transcript of all government proceedings so long as they are not classified in anyway. 6.All citizens of the Mexico shall have the right to petition the government for a readdress of grievances
Section 3. Freedoms of the people 1. People have the right to a safe happy life without of fear of physical or verbal harm, and no one shall have their life taken away from them by the government unless convicted in a court of law, and only for the most serious of heinous crimes. 1. Protection from discrimination No one may be discriminated against based on race, gender, ethnicity, age, religion, or sexual orientation.
2. Protection of being enslaved. People have the right not to live in slavery.
3. Freedom of Religion Congress may make no law regulating religion or prohibiting free exercise of religion
4. Freedom of speech, press, expression, thought, and body Congress may make no law that infringes on freedom speech, freedom of the press, freedom of expression, freedom of thought, and freedom to control what happens to their body so long as any of the above does not interfere with other people’s rights.
5. People shall have the right to bear regulated arms so long as they are not criminals, are 18 years of age and do not have any mental illness that can lead them to the harming other people.
Article 7 Amending the Constitution Section 1. Amending the constitution To amend the constitution at any time would take a majority vote of 2/3rd of both houses. Or 2/3rds majority of the states vote on an amendment.
Article 6 Ratifying the constitution. The constitution will go into immediate effect after being approved by 2/3rds of those voting.
