Hi Peaky, if the tenement is an EL (Exploration Lease) then a Section 20A is required which for the period of the permit will allow you to prospect to a depth of 2 meters. If it is on a dead tenement or crown land then you will have to apply for a Prospecting Licence which as I understand allows you to remove the surface ground provided that as stated in the W.A. Mining Act Section 46 paragraph (b) which states: " that all holes, pits, trenches and other disturbances to the surface of the land the subject of the prospecting licence which are:- (i) made while prospecting (ii) in the opinion of the State Mining Engineer, likely to endanger the safety of any person or animal, will be filled in or otherwise made safe to the satisfaction of the State Mining Engineer" My reading of that allows you to scrape the surface. If it is on a live/active tenement then you will need written permission from the Lease Holder to which I very much doubt will be given. Hope this answers your question. If you have any further questions can you please submit them in the FAQ Topic section of the forum. Cheers Ted |

Hello Peaky, if you were to peg this ground as a Prospecting Lisence once it has become live, you put in a mining proposal to move or dig the dirt ,originally called a NOI "Notice Of Intent", also another way is you can put in for a excess tonage removal but i believe the later is mainly used on SPL's, what Ted wrote is correct but you must have theses mining proposals current to do anything. cheers Kris |
