Pizza menu starring... Mario!

Mamma Mia Pizza (under new management) have posted a lovely menu through the door starring no other than the Mamma Mia quoting man himself, Mario. I found this rather amusing but isn't that against copyright?

It probably is. And this sort of thing isn't new or unique, either. I know I've seen a number of pics floating around of companies using copyrighted characters on their vans and things. Meh.

What I want to know is... Are there any pictures of this Mario menu about? :mario:

Well, hard to say actually. I don't know a whole lot about copyright laws, but I wouldn't think Nintendo would throw too much of a fit over this.

Yes, that would be a violation of copyright unless they actually paid for the rights to the character image. As far as I know, Mario and Luigi arent' in "clip art" status just yet.

I seem to remember my fiance' saying something about a local Mario Bros. Plumbing that used Mario and Luigi in its logo and got in trouble for it. They wouldn't get in trouble for the name because "Mario" is an actual, time-honored name, but the use of copyrighted character images for a business without procuring permission does constitute a copyright violation.

Fan Art is *technically* a violation of copyright as well (at least in U.S. Law, not sure on International), but companies generally do not care if you draw their characters -- I think Nintendo's one of those companies that actually encourages fanworks (I've seen that Ocarina of Time "How to Draw" book)

... but use of actual character images to promote an unrelated business... I can foresee the company getting into some kind of minor trouble for that, being asked to get a new logo.

If they're looking to hire a graphic design/logo artist, I am availble for freelance and have experience in logo design. *Grin.* That's what graphic designers do - create stuff for others, give away/sell the rights to the client.

In Japan there are fan made comics based on established characters from other works. There are even comic-making groups that dedicate themselves solely to the art/storyline of fan comics, and as far as I know, it's something that's accepted as normal there. The copyright misuse/violation fines seem to be more of a Western thing, but I'd need to look more into it to make sure before I said anything with any real conviction there.

But that being said, I'd like to see some of those menu pictures too, Juli. :)

Oh, I know about doujinshi. I even have a few - a pair of doujins for Trigun and one for Lord of the Rings ( all clean/gag, non-porn stuff. It seems that most doujinshi that's popular, at least at American cons... is yaoi porn).

I believe it is part of Japense culture to do fan-works and it's considered great flattery, so creators have more a tendency to allow it more than American creators, though that is changing and I'm still not sure on the copyright laws over stuff when it comes across the pond.

In any case, flat out character image use for a business is something considered a no-no unless a license is acquired.

Heck, I could give you stories of weirdness from the world of graphic design concerning the creating of imagery for a client and being forced to look through book after book and disc after disc of clip art because I was not allowed by bosses to just friggin' draw something for someone for a client's ad or business card. -- It's a pretty weird business sometimes, when it comes to legality and technicalities.

Also Paul was inspired to make his very own pizza at the weekend. Totally created from scratch indluing the dough base. Mmmm!!! It had mized herbs, tomato, mozzarella cheese, ham, mushrooms, green peppers, sweet red peppers and red onion. Yum!

But yeah, I'm a little surprised that they haven't gotten in trouble for this. As others have already said, fanarts are one thing, but using such an image to promote an unrelated business is quite another.

Wow. I was expecting someone to have tried to draw Mario or something (like those bad renditions of Disney characters you sometimes see on ice cream vans), not for them to have actually used the proper Mario artwork. They could get in serious trouble for that, make no mistake.

The italians have been doing this for quite awhile though. Some italian plumbing companies will actually grow mustaches and wear the overalls because of these game characters, and more often will carry keepsakes in the form of small Mario merchandise. Apparently they actually like Mario a LOT in Italy.

The menu is ADORABLE, but, yeah... I'm suprised the printer printed that up for them, unless they do in-house.

Definitely something they'd need a license for.

Although, I have to say, it's a pretty good menu design.

Haha that's excellent but I'm kind of disappointed we didn't get a menu seeing as we're only 2 streets away.I could phone them up and try and blackmail them into giving me free pizza but blackmailing someone who makes you food probably ain't a great idea.

I did laugh when I was flicking through the TV guide to see a 'Mario et Luigi cosmetics' hour on QVC though...

*Chuckles* I remember my Mum showing me the channel when those cosmetics were on once (this was about a year or two ago now). Oh, how we laughed at the name. They'd probably smell like sewers and mushrooms...

Wow, I was gonna say that it's pretty cute that they used a picture of Mario (for some reason I envisioned an old school mario), and I didn't think that it would really matter that it was copyrighted, but they are promoted the heck out of those pictures of mario! It's almost as if they're making him their mascot. I don't know if Nintendo will be so down with that.

As Shadsie said, Doujinshi are generally considered an honor over there, but they are still technically illegal in Japan. But they're treated the same as fanart for one reason or another. It's just their culture I suppose.

Anyway, using Mario on their menu is definitely technically illegal. It's hard to say if Nintendo will care or not, though, as it's somewhat more minor than using it on a logo.

It's still cool though. :lol:

Yeah it is, I just sort of suspected it to be a small reference to mario, instead of making it seem like he's their mascott :)

I doubt Nintendo will care through. Or even hear about it.
