Regional Constitution; just a thought

Endorsement swapping is a tactic used by raiders to subvert a Delegate...therefore it will be illegal.

The Founder heads up the Internal Affairs Dept.

There already is a court and even how to get a case called.

Time frame for elections is well stated in the forum by president.

Kind of hard to get everyone together on the same day...better to leave it open for discussion as a whole.

I agree with Azzy we need no new positions, and we should incorporate the government positions we currently have. I will be reviewing the first draft over the next few days. Would anyone want me to post the first draft? I feel it may be a good idea to make the first draft public. Since the consitution effects everyone.

(Out of consideration that he is the found and ultimately the one responsible for this Region and Forum.)

The Constitution of the Exodus Region


We, the People of The Exodus, recognizing the need for a set of Rules and a Structure by which We govern Ourselves as a Free Society, do establish this Constitution for the better government of the Region.


Article I – Bill of Rights

1. All The Exodus Nations are sovereign and have the right of self-determination in domestic policies.

2. Rights to free speech, free press, and the free expression of religion shall not be infringed.

3. Participation in the The Exodus Regional Government, Regional Forum, and Regional Military shall be voluntary.

4. No nation of The Exodus holding UN member status shall be obligated to endorse any legally government official of the The Exodus. The right to add an endorsement or withdraw an endorsement will remain a sovereign right of the UN member nation.

5. All The Exodus Nations have the right to be protected against the abuse of Endorsement Gathering/Swapping, and grants the government of The Exodus Region the authority to investigate and prosecute all incidences of occurrence.

6. All The Exodus Nations have the right to be protected against the abuse of powers by any legally elected government official.

7. No Nation shall be held to answer for a crime, unless on a formal indictment or at The Founder’s discretion, except in cases arising in the militia, when in actual service in time of war or Regional danger; nor shall any Nation be subject for the same offense to be twice put in jeopardy; nor shall be compelled in any criminal case to be a witness against itself.

8.When charged with criminal activity, The Exodus Nations shall enjoy fair and impartial trials. No Nation shall be ejected from the region, or banned from any forum, without due process of law or at The Founder’s discretion. Should a legally elected government official declare the ejection or banning to be a matter of immediate regional security, the ejected or banned Nation shall have recourse to judicial review of the matter, and may be represented by any counsel of the Nation’s choosing. At the discretion of the Chief Justice, such hearing may occur in a locked forum.


Article II - Government

A. Executive Branch

1.The Founder
a. By nature of the fact the Founder created and established The Exodus, The Founder is the highest official designation.
b. The Founder is responsible for and has final authority to rule and take action in all issues and activities relating to The Exodus Forum.
c. The Founder is responsible for and has final authority to rule and take action in all issues and activities relating to the overall general welfare of the Exodus Region.
d. The Founder is vested with the authority:
i. To eject any nation of The Exodus with cause
ii. To take action deemed necessary in the event of any real or perceived which poses to destroy The Exodus?
e.The Founder has the sole authority to appoint/dismiss The Secretary of State of The Exodus
f. The Founder shall obey and respect the laws and regulation of The Exodus, when not engage in his executive capacity.

2..The Secretary of State

a. The Secretary of State is selected by the Founder.
b. The Secretary of State serves as an advisor to the Founder.
c. The Secretary of State with the express authority of the Founder can act in the temporary place of the Founder. This temporary status is limited in its scope for time and circumstances.
d.The Secretary of State also serves a the head of the R___ P_____ A____ (RPA).( Regional Protection Agency ????)
e.The Secretary of State shall obey and respect the laws and regulation of The Exodus, when not engage in his executive capacity
f.In the event of unforeseen circumstance which may prevent the Founder from the continuing activity of The Exodus.
i. The Secretary of State will continue service to The Exodus as a Elected Official.
ii. The Secretary of State status will be titled as The Acting Secretary of State
iii. The Senate will hold a special session to determine to proper tern and qualification of a candidate seeking this position and will take action necessary to select The Secretary of State.
iv. The Senate will then begin the processes to appoint The Secretary of State.


3. The Minister of Internal Affair

B. Foreign Relations
1. UN Delegate of The Exodus Region
a. The prime responsibilities of the Delegate are to be the Guardian of this Constitution, to provide a stable environment for the region as a whole, and to serve as a public symbol of regional unity and leadership.
b. All The Exodus Region Nations, and the Regent, must stay below 75% endorsements of the current Delegate of The Exodus

i. An exception to the 75% Endorsement Rule is granted to Qualified Delegate candidates, during a Delegate election.
ii. All Qualified Delegate candidates, who are unsuccessful in their campaigns and not elected , must contact their endorsing nations and require the endorsements be withdrawn.
iii. All Qualified Delegate candidates, unsuccessful in having endorsements withdrawn, are required to Officially leave The Exodus Region join an other region, to remove all The Exodus endorsements, and then return to The Exodus.
iv. All other The Exodus Nations are prohibited from the practice of Endorsement Gathering and/or swapping.
v. Violators of the Endorsement Gathering and/or Swapping Provisions, will be expelled from The Exodus.
c. The Delegate shall only vote on UN Resolutions in accordance with the will of the majority of UN nations residing in the region.
d. The Delegate shall alter the fact book entry, upon the recommendation of the appropriate Minister, as determined by law.
f. The Delegate may not also serve as an legally elected Government Official.
g. The Delegate shall be limited to no more than four consecutive terms of office.

2. The Diplomat of The Exodus Region
a. The Diplomat of The Exodus Region is selected and appointed by UN Delegate of The Exodus Region

3. Minister of Foreign Relation of The Exodus Region
a. The . Minister of Foreign Relation of The Exodus Region is an elected position

C. The Senate of The Exodus

1. The Senate of The Exodus will as a mini-UN for The Exodus Region
2.The Senate of the The Exodus is the governing and lawmaking body of The Exodus. Laws shall be deemed passed if they receive a majority of those members voting.
3. The Senate of The Exodus will discuss and rule on Porposed resolutions and Recognized issues.
a. Porposed resolutions and Recognized issues, can be presented by any non-Senate The Exodus Nation
i. These Porposed resolutions and Recognized issues, must be first Lobbied to any of the seven senators for presentation.

4. The Senate of The Exodus shall consist of seven members, one of which serves as Speaker of The Senate.
a. The membership of The Senate of The Exodus shall constist of
i. Five Senators elected by the popular vote of the member nations of The Exodus
ii. The Minister of Foreign Relations
ii. The Minister of Interior
b. The Senate of The Exodus shall have a weighted vote, constituting nine (9) votes, as defined:
i. Each elected regional Senator shall cast one (1) vote.
ii. The Minister of Foreign Relations shall cast two (2) votes.
iii. The Minister of Interior shall cast two (2) votes.
c. The Senate of The Exodus vote shall be considered a majority vote with a minimum of five (5) of the total nine (9) votes cast.
d. The Speaker of The Senate of The Exodus, may exercise a veto of any majority vote of The Senate of The Exodus
e. A veto by The Speaker of The Senate of The Exodus can be re-voted and passed by The Senate of The Exodus with a Super Majority vote, as defined:
i. A Super Majority vote shall consist of a re-vote with a minimum of six (6) of the total nine (9) votes cast.
f. A Super Majority Vote of the Senate may eject any Senator from its The Senate of The Exodus.

5. Eligibility for Senator in The Senate of The Exodus requires
a. Residency in The Exodus
b. Membership in the UN, with a minimum of _____ endorsements
c. Population minimum of ____Million
d. Minimum time of participation in the forum of ____ days, as determined by join date.
e. Post of at least __ posts daily Total posts divided by Number of days.

6. A candidate for The Senate of The Exodus can be disqualified, upon the successful challenge of two other Senators.

7. The election of new Senators of The Senate of The Exodus shall:
a. Be based on a simple majority of votes cast by eligible Regional Nations for Qualified candidates.
b.The names of all eligible Regional Nations for Qualified candidates, shall be prominately posted at the desiginated Forum & Topic within The Exodus Regional Froum..
c.The Votes will be cast in a desiginated Forum & Topic within The Exodus Regional Froum.
i. The method of casting ballots and counting votes shall be secure and be of the type where voting abuse can be identified and voting fraud prosecuted.
d.The names of all eligible Regional Nations for Qualified candidates, shall be posted at the desiginated Forum & Topic within The Exodus Regional Froum.
e. The result of ballots cast are to be displayed in a Public area within The Exodus Regional Froum.

8. A Senator of The Senate of The Exodus may be removed for his/her Seat, after a hearing to determine cause, if:
a. That Senator leaves the Region for any reason, excluding while on official regional business.
b. That Senator’s endorsements fall below the minimum of ___ endorsements, excluding due to official regional business.
c. That Senator’s posts fall below the minimum of ___ posts.
d. That Senator acts in a manner detrimental to the Safety and Well-being of The Exodus Region.

9. Should a Senator leave office prior to the conclusion of his/her Regular Term.
a. The Senate of The Exodus shall by a majority vote of the remaining Senators, select a Qualified candidates to serve as Acting Senator for the remander of the departing Senator term.

10. The Senate may question any Minister or other elected government official about the performance of his/her duties.
a. The Founder and The Founder’s Secretary of State are exempt, but may voluntarily comply.

11. The Senate of The Exodus shall sit in continuous session.

12. The Senate shall maintain a publicly available roster of all current member nations.

13. The Senate may approve treaties and declare war.

14. The Senate may hear any appeals to judicial decisions on criminal cases that it deems necessary.

15. If this Constitution is approved and ratified during the time a duly elected Senate already exists.
a. The existing Senators will continue their regular term as defined by the law existing at the time of their election to The Senate of The Exodus.
i. Extension of this term will not be allowed.
ii. At the conclusion of their regular term this constitution will prevail.

D. The Speaker of The Senate of The Exodus

1. The Senate of The Exodus shall elect one of its members as a The Speaker of The Senate of The Exodus

a. Keeping order
b. Enforcing rules of conduct.

c. to suspend a Senator for up to ten days.

4. The Speaker of The Senate of The Exodus shall determine if Qualified candidates for The Senate of The Exodus meet the appropriate requirements.

5. The Speaker of The Senate of The Exodus shall determine if Senators of The Senate of The Exodus continue to meet the appropriate requirements.

6. The Speaker shall serve for a term of _______, unless a super majority of The Senate of The Exodus advances a motion of no-confidence in him/her.

E. The Ministries of The Exodus Region

H. Amendments

1. This Constitution may be amended by a resolution

i. The Exodus Member Nation must lobby a Senator who will present it before the Senate of The Exodus.



Article III - Conclusion

How did the provision that a nation needs to be in the UN get past AA? I had always thought and it's included in the begining that no nation shall be forced into the UN...so why do the elcted officials need to be in the UN? Just an observation...looks good otherwise...as an afterthought SecState should also have something about regional security listed...other than the RPA

I agree with Lux, I am sorry I have not officially reviewed the consitution yet. real life is wicked busy. I had hoped rael one would post and he has, and I was hoping other nations would look it over.

Lux you are right, no one has to join the UN. it is completely voluntary. We cannot force nations to be in the UN, and this has always been our policy.

Also, there are very few requirements for holding governmental positions. You must have intentions of living in our region. We do not want a nation that will hold a position and then leave us. Also, you can be UN or non UN, it does not matter. There is no minimum residency time that you must have before you run or at least this is how it has been. We encourage all nations to get involved in our region.

Good for a starter. I would also like to see position requirements relaxed a lot, particuarly this UN stuff. What's the deal with the term limits anyway?

Can we throw in a right to voluntary participation in the UN then?

I also noticed H,1,b - I don't think we should lob member nations around. Perhaps you mean lobbying.

It is a large and long document which is as times difficult to read and review.

Ok- I'd first like to thank R.O. for all that hard work, we were all sitting around hoping someone else would do it, and you did. Here are Senatator Edgerspune's initial comments to the First Draft:

Art I [I now realise these comments are mostly ou of date]

1- Complete inability to influence the domestic policy of resident nations would make common military and economic cooperation impossible. This clause is also contradicted by this document's attitude to UN membership and requirements for holding office.

4- You'd have to put in something here to allow for defence from conspiracies.

7- This is unclear. What is a 'formal indicetement'? What is this about the militia and service in the time of war? "nor shall any Nation be subject for the same offense to be twice put in jeopardy; nor shall be compelled in any criminal case to be a witness against itself."
This would hamper the high courts and the senate in the pursuit of justice. We must be allowed complete freedom to investigate any activity that concerns a resident nation, or the puppet of a resident nation.

8- Defendants should be allowed the right to appeal to the Senate, as a democratic body.

Art II
A1a- The Founder should be defined as 'Head of State, and Executor of the Law, Senate and People of The Exodus.
c. - 'final authority' is a bit strong, see below.
d i, ii - The term 'with cause' is a bit vague, I feel the Founder should not eject a nation unless as a result of a Senate or High Court ruling, or in the event of an emergency when swift action is required [perhaps we need an Emergency Powers section] or when the High Court and Senate are both inactive [unlikely I know]. Since the complete destruction of the Exodus is impossible, we need to be more specific here as well.
f- surely the founder shall obey the laws and regulations of the Exodus especially when acting in their executive capacity, and I believe one of the main purposes of this document is to provide a clear code by which the Founder should govern this region, with the consent of the democratically-elected government.

A2d -At the moment, the RPA and the Secretaryship of state are both held by Lux, but it is reasonable to allow the Secretary of State the ability to appoint a separate head of RPA.
e. Same goes as for A1f
f. - good.

A3- This is where we first see the 'eligibilty requirements'. We cannot support a document which has any eligibility requirements for entry to any government position other than public election of the nations of the Exodus, or the appointment of the appropriate government body. We must place complete trust in the democratic process, and the judgement of the electorate.

B.1a. Surely the prime responsibility of the UN delegate is to vote on UN resolutions the way that the majority of the nations of the Exodus, including non-UN members, would wish them to vote.
b i -we need to explain the process of a Delegate Election, maybe we could have set terms. Perhaps we also could allow one nation to be endorsed more than 75% of the delegates endorsements as a deputy.
v. This is too harsh. I thought we had a warning system in place for first-time offenders. I also think 'gathering' is not such a serious crime, especially with the 75% rule.

C3.- The Senate should have the ability, with the consent of the High Court, to amend this document. Also to overturn any high court ruling, and to request a vote of no-confidence in any government official other than Founder, have the ability to vote on Bills calling for the expulsion of nations resident to the Exodus, and be able to take command of the RPA in the event of governmental crisis, to be able to request the use of RPA forces as peacekeepers in any conflict in The Exodus . [I'm sure I can think up some more powers for the senate...]

i- that's good, I think the bills should be put to the house, and then debated, and possibly altered, like this document is now.

4-In the eventuality of there being many more active nations in this region, it may be desirable to enlarge the senate.
e i- The speaker's veto is pointless if it can be overturned by another majority vote. Perhaps only by a unanimous vote.

5b. Konutland is not and never will be a member of the UN. We have also been elected to the Senate by a large majority of the electorate. This clause infringes on the sovereignty of Senate member nations, and ensures a senate of a particular political character.

6. - This sounds unreasonable. Explain 'successful challenge'.

8a- we should allow movement from the region for a short amount of time.
b. see 5b
c. I don't think that the disciplining of a Senator should be up to the Courts, but up to the Senate, or the electorate. The Senate should deal with these matters with a vote of no confidence in a given Senator.

10. a. I see no reason why anyone should be exempt from answering questions.

D1. it appears we are currently having a public vote on this, but we prefer a Senate-elected speaker.

4, 5. This makes the speaker a dictator.

G- We need a section on the high court. At the moment, Lux seems to be overboss, with Judge Azzy presiding, but the system for electing a High court Judge needs to be put down. And the Senate should be in charge of hiring/firing Judges.

Article I – Bill of Rights

1. All The Exodus Nations are sovereign and have the right of self-determination in domestic policies.

2. Rights to free speech, free press, and the free expression of religion shall not be infringed.

3. Participation in the The Exodus Regional Government, Regional Forum, and Regional Military shall be voluntary.

4. No nation of The Exodus holding UN member status shall be obligated to endorse any legally government official of the The Exodus. The right to add an endorsement or withdraw an endorsement will remain a sovereign right of the UN member nation.

5. All The Exodus Nations have the right to be protected against the abuse of Endorsement Gathering/Swapping, and grants the government of The Exodus Region the authority to investigate and prosecute all incidences of occurrence.

6. All The Exodus Nations have the right to be protected against the abuse of powers by any legally elected government official.

7. No Nation shall be held to answer for a crime, unless on a formal indictment or at The Founder’s discretion, except in cases arising in the militia, when in actual service in time of war or Regional danger; nor shall any Nation be subject for the same offense to be twice put in jeopardy; nor shall be compelled in any criminal case to be a witness against itself.

8. When charged with criminal activity, The Exodus Nations shall enjoy fair and impartial trials. No Nation shall be ejected from the region, or banned from any forum, without due process of law or at The Founder’s discretion. Should a legally elected government official declare the ejection or banning to be a matter of immediate regional security, the ejected or banned Nation shall have recourse to judicial review of the matter, and may be represented by any counsel of the Nation’s choosing. At the discretion of the Chief Justice, such hearing may occur in a locked forum.

I agree there needs to be some sort of emergency powers section to the consitution.

I should be able to eject nations in an emergency for example if I believe raiders have entered our region I would need to be able to eject them fairly quickly and this could not be handle by the senate or court since that would take time. Does this make sense?

Question, can we have elections for U.n. delegates, beacuse if the people of the region feel like it they could make anyone into that role at any point or time.

I have given it a lot of thought, but I can't agree with the way our senate works right now. The ancient Romans had a great idea about politics: the so-called "Trias Politica", which divides the three main power in a country. The trias politica gives an important role to the controlling part of the whole system.

Now with the current Exodus system there are government members in the Senate, which means that the government of the Exodus has a say in the control of the government of the Exodus. This will get us in trouble.

Now I see the necessity of someone defending the government statements in the Senate, but I do not think that this person should be able to vote as a Senate member. So my idea is that the senate contains 7 members who are not in the Exodus government and that the Exodus government members explain (and/or defend) their decicions in the senate forum, so the senate can make independent decisions without the government being left out of the discussion.
