Car Insurance; 3rd party only when its not? my fault

I was driving my daily car(Honda crx) today and crashed into an audi a4 at about 5:30pm.
I was going straight and he was turning right into his driveway.
My front left hit his rear left wheel.
His fault right..??

He says he doesnt have any insurance and im only covered for 3rd party..

any ideas on what I could do if he starts to deny that it was his fault?
cause he started saying that he wasnt sure if it was his fault because he couldnt see me coming.. then he shot off saying that he was late for the gym..

I got his drivers license details and contact details.
I checked his registration number too and it seems to say his last wof failed and he still hasnt got a new one yet. could I use that against him?

any comments or ideas would be appreciated..

3rd party only pays out for the other person and only the other person if its yours fault correct me if I wrong... but I think its his fault he pays.. if he has insurence or not! But ring your insurence company tomorrow they will explain it.. Good luck =]. Hoefully it was a real nice audi and it messed it up real bad and your car is all good! some people just shouldnt be on the road!

Yeah that is another good point.. But whats he going to say I was driving north he was driving south and pulled out into his drive right infront of me.. its pretty clear cut?

I DID try call the police, but I think they didnt come cause there were no injuries and it was nothing big..

I just got a call from my insurance company saying that the audi driver is dening it was his fault so the insurance company cant do anything about it now..

they just left me a number to call the citizens advice bureau..

really annoying..

Anyway, go through all the nice civilised methods of getting money out of him- it was obviously his fault if he turned across you, then go round, flatten his tyres and set fire to the car!

I went around to someone who owed me money late one night and left their car on bricks.... Got paid real quick when they wanted their wheels back! :D

You should be able to press charges through the Police, he has committed a criminal act (Failure to give way) and it is their job to prosecute. Once he has been found guilty then your job of extracting money through the small claims Court is much easier.

Had to do that to a young guy who failed to give way coming out of a parking lot one night and wrote my motorbike off (and nearly me!)

I tried to take photos of everything possible with my phone camera.
There were not any potential witnesses either.. so i tried calling the cops too, but they didnt come.. The other driver is young too.. I think hes denying cause he cant afford to repair..

Im going to try everything I can to get him to repair my car, wasnt going to try this hard but since hes being dishonest, its really fustrating...

Ill see what the citizens advice bureau says about this tomorrow..

anyone know if ill be able to press charges on him for driving an 'unWOFed' car?
I checked up his registration(EJF47) on carjam and it says he doesnt have a current WOF.

Those photos are pretty damming- he can't deny that! Your red paint on his rear left wheel...

The Police should definately get involved if he didn't have a WOF and he failed to give way.

The mention of talkback radio or local newspapers or similar bad publicity can often motivate the Police.

First rule I learnt the hard way is always get a witness. If you've someone impartial to the accident that will write a statement saying you weren't at fault then you're pretty much sweet with the insurance company & police.
Next provide the insurance with photos of the crash site. If there's any tyre/skid marks on the road, get pics of them (you don't have to do this on the day but do it within a couple of days while any evidence is still there). Draw a detailed diagram of the scene showing where each car was coming from & point of impact etc. If you go to the insurance company with as much info as possible to prove you weren't at fault then it obviously increases your chances of getting paid out.

Also depended on your 3rd party policy they will pay out to repair you car in a accident that wasn't your fault up to something like $3500.

Take his wheels like greeneyes said. Im sure that he'l pay for them once he cant drive. If you do see him driving again without a wof you could try the dob in a driver line (*555) and just tell them that hes driving erractically theyll get cops onto him and pull him up check his wof and if its out then give him a fine.

Ive tried giving him a letter to pay for the damages, but he keeps ignoring me so im just going to take him to the disputes tribunal.

if his car had no WOF, it should not have been on the road in the first place, which makes him at fault wether you were actually at fault or not. so therefore he needs to pay for the damage on your car.

and if you still have no luck, just buy a big bottle of brake fluid and go to his house one night and pour it over his car. a new paint job wont be cheap! my ex gf found that out...........lol.

haha, you guys are the best.
anyway, ive filed a claim with the disputes tribunal, so hopefully something will happen. trying to get the police to find out whose fault it is officially too and maybe notice that he doesnt have his wof and registration up to date :P
